01About these terms

The site is operated by Badgyver, based in Spain (see the Legal Notice). In these terms, “we”, “us” and “our” mean Badgyver, and “you” means the person using the site or buying from it.

If any part of these terms conflicts with the Licence Agreement on how a product may be used, the Licence Agreement prevails for that question.

02Your account

Accounts are created and accessed exclusively through Discord. When you sign in, Discord shares with us your Discord ID, username, avatar and verified email address, and we use them to create and identify your account.

• You must be at least 16 years old to create an account. To make a purchase you must be of legal age to enter into a contract in your country, or have the consent of a parent or legal guardian.
• You are responsible for everything done through your account and for keeping your Discord account secure.
• One account is for one person. Accounts may not be shared, sold or transferred.
• Keep the information in your account accurate, including the community and server details you register for your licences.

03Our products

Everything sold on badgyver.com is digital content for the video game Rust: custom maps, monuments, prefabs, arenas, map templates and server plugins. Nothing physical is ever shipped.

Each product page describes what the product includes, its requirements and, where available, screenshots, videos, a 2D map and an interactive 3D preview. We work hard to make these descriptions accurate, but small differences in appearance can occur between game versions and server setups.

04Prices and payment

• Prices are shown in US dollars (USD) and are the final price you pay: any VAT or sales tax that applies is already included.
• Payments are processed by PayPal, including card payments, Apple Pay, Google Pay and the local payment methods offered at checkout. We never see or store your full card details.
• We may change prices, run sales or withdraw products at any time. A change never affects an order that has already been placed: your order keeps the price you paid.
• If a product is listed at a clearly wrong price because of an obvious error, we may cancel the order and return the full amount paid before the product is delivered.

05Delivery and downloads

Your purchase is delivered immediately after the payment is confirmed. The files are available in the Downloads section of your account, and the order confirmation email contains the download links.

• New versions we publish for a product appear in your account downloads at no extra cost.
• Download links are personal. Do not share them: they are tied to your order.
• Please keep your own backup of the files you download.

06Refunds

Because our products are digital content delivered instantly, all sales are final and we do not offer refunds. Instead, we help you get the product working. The details are in our Refund Policy, which forms part of these terms.

07Licences

When you buy or download a product, you receive a licence to use it; you do not acquire ownership of the product or its files. What you may and may not do with each type of product, and how plugin licences are tied to your community, is set out in the Licence Agreement.

08Free products

Some products are offered free of charge to signed-in members. Free products are covered by the same Licence Agreement as paid ones: they may be used, but not sold, re-uploaded or redistributed. We may stop offering a product for free at any time; what you have already downloaded remains yours to use.

09Updates and support

• All support is provided through the ticket channel of our Discord server.
• We fix defects and update products when Rust, Oxide/uMod, Carbon or RustEdit change, but we cannot guarantee that every product will remain compatible with every future game update, or for any specific period of time.
• Support covers our products. It does not include installing them for you, configuring your server, or fixing problems caused by other plugins, hosts or modifications.

10Acceptable use

When using the site, you agree not to:

• share, resell or redistribute our products or download links, or help anyone else do so;
• bypass, disable or interfere with the licence verification of our plugins;
• attack, overload, scrape or try to gain unauthorised access to the site, its accounts or its systems;
• use the site for fraud, including purchases with payment methods you are not authorised to use;
• open a payment dispute or chargeback for a purchase you made and received, instead of contacting us;
• impersonate others or provide false information.

11Intellectual property

All products, files, images, videos, texts and designs on badgyver.com are the property of Badgyver or are used with permission, and are protected by copyright and other intellectual property laws.

Rust is a trademark of Facepunch Studios Ltd. Badgyver is an independent creator and is not affiliated with, endorsed by or sponsored by Facepunch Studios. Other trademarks belong to their respective owners.

12Third-party services

The site relies on services run by other companies, such as Discord for sign-in, PayPal for payments and YouTube or Vimeo for product videos. Your use of those services is also subject to their own terms and privacy policies, and we are not responsible for their availability or content.

13Suspension and termination

We may suspend or close an account, and revoke the licences attached to it, if the account is used to break these terms or the Licence Agreement, to commit fraud, or to obtain a payment reversal for a purchase that was delivered. You may stop using the site at any time and ask us to delete your account as described in the Privacy Policy.

14Disclaimer

Products are provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranty that a product will meet every requirement you have, run without interruption on every server setup, or be free of every error. Nothing in these terms excludes the guarantees that consumers are entitled to under the mandatory law of their country.

15Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect or consequential losses, such as loss of data, loss of server population, loss of income or loss of profit, arising from the use of or inability to use our products or the site. Our total liability to you for any claim is limited to the amount you paid us for the product concerned. These limits do not apply to liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

16Changes to these terms

We may update these terms from time to time, for example when we add new features or when the law changes. The date at the top of this page shows the latest version. Changes apply from the moment they are published and never affect purchases made before that date.

17Governing law and disputes

These terms are governed by the laws of Spain. If a dispute arises, please contact us first: most problems are solved quickly that way. Any dispute that cannot be resolved amicably will be submitted to the courts of Spain. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and the right to bring proceedings before the courts there.
